The petition sought compensation for injuries allegedly related to the baby’s receipt of the Measles-Mumps-Rubella (“MMR”) vaccine, the pneumococcal conjugate (“PCV”) vaccine, and/or the varicella vaccine which she had received as part of her childhood immunizations. After litigating this case for over four (4) years, the Marcarian Law Firm obtained one of the largest compensations awarded in the history of the Vaccine Program to a victim of a vaccine injury. The compensation included an amount sufficient to purchase annuity contracts, over Thirty-Three Million Dollars ($33,000,000.00), which would provide for payment of nearly all of the child’s needs up until the time of her death.
In addition to the lifetime care obtained for its client, the Marcarian Law Firm also obtained a lump sum payment of $662,591.70, which amount represents compensation for partially lost future earnings ($381,482.48), pain and suffering ($236,109.22), and home modification expenses ($45,000.00).
Moreover, the Marcarian Law Firm also obtained an additional lump sum of $681,755.02 to pay for all of the claims and liens asserted by the State of California, the Medi-Cal Program.
