Los Angeles Wage and Hour / Labor Attorney

Workers in California deserve to receive fair wages. The employment laws in this state provide great protections for employees, including the right to be paid a minimum wage and overtime. Unfortunately, there are times when employers disregard the laws and take advantage of their workers. At the Marcarian Law Firm, P.C., our team is here to help when you need a Los Angeles wage and hour/labor attorney. Our lawyers have extensive experience handling complex employment law cases, and we know what it takes to investigate these claims in order to secure the compensation that our clients are entitled to.

Wage And Hour Laws In The State Of California

One of the most often violated wage and hour laws in California revolves around providing minimum wage for employees. In nearly all circumstances, employers in this state must pay the minimum wage as prescribed by law. As of January 1, 2021, the minimum wage is as follows:

  • $14.00 per hour if an employer has 26 or more employees.
  • $13.00 per hour if an employer has 25 or fewer employees.

Minimum wage increases will continue at $1.00 an hour each year until 2023, which will cap out at $15.00 an hour for every worker, regardless of how many employees there are within an individual company.

In addition to minimum wage law violations, we also know that employers in California regularly try not to pay their workers the overtime they are entitled to. Under California law, all non-exempt employees are entitled to overtime pay if they work more than 8 hours in a single day or more than 40 hours in a single workweek. Overtime pay in California is time and a half (1.5) their regular wage. Additionally, workers in this state will be paid double their regular wages if they work more than 12 hours in a single day or more than 8 hours on the seventh consecutive day during the workweek.

These are certainly not the only issues under which wage and hour disputes may arise. Other violations can occur in Los Angeles and throughout California, including:

  • Non-payment of meal or rest breaks
  • Requiring off-the-clock work
  • Refusing to reimburse for expenses
  • Not paying employees quickly enough
  • Not paying after termination
  • …and more

Q&A with Marc McCulloch:

Interviewer: What Should I Do If My Employer Is Not Following The California Labor Laws?

Marc McCulloch: If you have a suspicion that someone is not following California labor laws, give us a call. Call the Marcarian Law Firm to speak to one of our attorneys. Many times people may think that something is illegal or unlawful when it is not. It may be drastically unfair, but it may not be unlawful. Contact our office to talk to us and we will try to determine whether or not what your employer is doing is unlawful. We may need to see documents; we may need more information. But, the first thing you should do is give us a call – don’t wait because the law only gives you so much time to file a lawsuit.

Interviewer: Why Should I Hire The Marcarian Law Firm To Represent Me In A Wage Dispute?

Marc McCulloch: The Marcarian Law Firm has had a great deal of experience dealing with California’s wage and hour laws. We have represented a number of individuals in class actions against some fairly sizable employers in the state of California. We do know the wage and hour law, and stay abreast of that. We are a small law firm and pay individual attention to our clients. In other words, from intake to the trial, we are with our clients every step of the way. We do not have an associate prepare the case and hand it off to a trial attorney we never met until two days before trial. You will get to know us; we will get to know you. We feel that is a great advantage.

If you (or someone you know) have been treated unfairly by your employer, contact the Marcarian Law Firm, P.C. for a consultation concerning your particular situation 800-924-3784.
